According to Subsidiary Legislation 552.15, Development Planning (Use Classes) Order, published on the 28th of February 2014, commercial properties in Malta are categorized into eight classes. Each class requires a specific permit, ensuring compliance with legal standards and maintaining a valid business license.
The 8 Commercial Property Classes
1. Category A – Residential Uses
Category A covers properties that serve both residential and commercial functions. These properties include homes or apartments that also operate commercially, providing services or conducting business within the residential space.
2. Category B – Social Uses
Category B is divided into three sub-classes:
- Class 2A – Residential Institutions: Permits for facilities providing care, such as hospitals, nursing homes, and clinics.
- Class 2B – Non-Residential Institutions: Permits for museums, libraries, public halls, and similar establishments.
- Class 2C – Education: Permits for educational institutions, including kindergartens, daycare centres, and schools.
3. Category C – Tourism and Leisure Uses
Category C includes properties related to the tourism industry, excluding those licensed to sell alcoholic beverages to non-residents:
- Class 3A: Permits for guesthouses, boutique hotels, hostels, and other temporary lodgings.
- Class 3B: Specific to hotels in Malta and Gozo.
- Class 3C and Class 3D: Permits for assembly and leisure venues (e.g., cinemas, theatres, health clubs) and marine leisure activities (e.g., mooring, sailing, diving).
4. Category D – Commercial Uses
Category D covers various commercial uses:
- Class 4A: Permits for financial, professional, and other office-based services.
- Class 4B: Retail outlets and display spaces for selling goods, excluding motor vehicles.
- Class 4C: Food and drink establishments where cooking is not allowed.
- Class 4D: Catering establishments that offer hot or cold food and drinks for consumption on-site, where cooking is permitted.
5. Category E – Industrial Uses
Category E includes:
- Class 5A – Light Industry: Permits for product development, crafts, and light industrial activities.
- Class 5B – General Industry: Permits for broader industrial processes.
- Class 5C – Specialised Industry: Permits for specific industrial processes, such as meat or mineral processing.
6. Category F – Storage and Distribution
Category F pertains to storage and distribution:
- Class 6A: Permits for storage and distribution of boats.
- Class 6B: Permits for boatyards.
7. Category G – Agriculture
Category G includes properties used for intensive farming:
- Class 7: Permits for the intensive raising of crops or animals.
8. Category H – Aquaculture
Category H covers aquaculture activities:
- Class 8: Permits for facilities engaged in the breeding or fattening of fish.
